Article 1 - Scope of Application
The General Terms and Conditions of Sale described below (hereinafter "the General Terms and Conditions of Sale) are intended to govern all contractual relations between SAS Lignea Kids with a capital of
10.000 euros, whose registered office is located at 66 avenue des Champs-Elysées- 75008 Paris; RCS PARIS 900 759 176; N° TVA intracommunautaire FR33900759176 (hereinafter "Lignea Kids" or "We") and customers over 18 years of age and with full legal capacity (hereinafter "The Customer" or "You") placing an order through the Site www.ligneakids.com (hereinafter "the Site").
The Terms and Conditions of Sale apply without limitation or qualification to all sales of products listed on the Site.
Putting an order through the Site implies the unreserved acceptance of the General Terms and Conditions of Sale by the Customer. Lignea Kids reserves the right to modify these Terms and Conditions of Sale at any time. Lignea Kids therefore invites you to read the General Terms and Conditions of Sale carefully with each new order placed. The General Terms and Conditions of Sale applicable will be those in force on the day the order is placed.

Article 2 - Your order
Ordering the products you select (hereinafter the "Products") will be done according to the process described below.
2.1. Your identification:
You will access the contents of your shopping cart, including all Products. You must then proceed to your identification. In this respect, you undertake to provide Lignea Kids with accurate and reliable information, thus enabling us to carry out all our contractual obligations.
Linea Kids shall not be held liable in the event that the information you have provided proves to be false or incomplete. In this context, or in the event of non-payment or any other irregularity in your account, Lignea Kids reserves the right to cancel your order and/or delete your user account. Your identification may be made directly after selecting Products or through your user account (hereinafter the
"Account"). The opening of an Account includes the seizure of two identifiers: an email address and the choice of a password. Your identifiers are personal to you and must be kept confidential.
You may access the personal data you have provided to us upon request, in accordance with the provisions set forth in the Personal Data article of the General Terms and Conditions of Sale.
2.2. Putting your order in:
Once you have selected the products and filled in your identification data, you then proceed to select your payment method. A summary of your order is then presented to you, which will include information on the Products, prices and delivery terms. You will also be given an order number.
2.3. Confirmation definitive of your order:
Once the order has been validated, the final validation of your order will occur when the bank authorization for debit has been given to Lignea Kids. A final confirmation will then be sent to you, setting out all the elements relating to your order.
Only the final validation of the order commits Lignea Kids to the Customer. Your invoice will be sent to you by email after receipt of your package.
2.4. Product availability:
The items are offered to the Customer within the limits of available stocks. Thus, in the event of the Product ordered being unavailable, Lignea Kids undertakes to inform the Customer as soon as possible and will proceed with the reimbursement of the Product (including delivery costs) within a maximum period of 30 days. In this case, Lignea Kids will proceed with the cancellation and refund of your order.
Article 3 - Product Prices
The prices indicated on the Site are indicated "All Tax Included" (TTC), and take into account the cost of disposal of waste electrical and electronic equipment (the ecocontribution). Unless otherwise indicated, the prices indicated do not include shipping costs.
Article 4 - Payment of your order
For any Order placed, payment is effected in full at the time of the Order, by bank card or PayPal account.
All bank data entered is subject to secure processing and is immediately encrypted. This information is only accessible to our banking partner, so that he can contact your bank. At no time can Lignea Kids or any other third party have access to your bank details. Your payments are transmitted to our banking partner on the day of the order.
It is debited on the day your order is placed.
Article 5 - Security of your means of payment
In order to guarantee a maximum of security during the orders, all payments by bank cards are secured by the system proposed by 3D Secure. This system is based on cryptographic techniques that ensure the confidentiality and integrity of exchanges. Thus, when you enter your bank details (card number, validity date and code), these are automatically chiffered and sent in secure mode to a server.
Parallel to this, Lignea Kids sends to this same server, again in secure mode, data specific to your order (merchant number, transaction number, order amount). The system offerted by 3D Secure effects a check of the card and a request for authorization from your bank using a private banking network. The 3D Secure system returns the confirmation of the payment and sends you back to the Site. The 3D Secure system then takes care of the payment with our banking partner.
Article 6 - Delivery of your order
Delivery is understood to mean all of the means implemented for the delivery of the Products ordered through the Site. Deliveries can be made in metropolitan France and abroad. The delivery will take place at the address that the Customer will have indicated at the time of placing the order. Delivery shall take place within the time indicated on the order confirmation sent to you by Lignea Kids.
Lignea Kids undertakes to use all necessary means to ensure that the delivery dates indicated are respected. Also, in the event that Lignea Kids is informed of a delay in delivery, the latter undertakes to notify you as soon as possible.
Delivery deadlines run from the day after the payment effected, subject to acceptance of the latter.
Failing any indication or agreement as to the date of delivery or performance, the trader shall deliver the goods or perform the service without undue delay and no later than thirty days after the conclusion of the contract.
No later than thirty days after the conclusion of the contract, the consumer may rescind the contract, by registered letter with acknowledgement of receipt or in writing on another durable medium, if, after having enjoined the trader to effect the delivery or provide the service within a reasonable additional period, the trader has not performed within that period.
The contract shall be deemed to be terminated upon receipt by the trader of the letter or writing informing him of such termination, unless the trader has performed in the meantime.
Your order will be reimbursed within a maximum of thirty (30) days following receipt of the request. If delivery has taken place before your request for cancellation has been taken into account by our services, you will return the Product to the following address SAS Lignea Kids, 66 avenue des Champs-Elysées- 75008 Paris.
Delivery costs depend on the weight of the Product in accordance with the delivery packages offered by Lignea Kids as indicated in the "delivery" section of the Site.
The "light" weight indication corresponds to Products weighing between 0 and 10 kg. The "medium" weight indication corresponds to Products from 10 to 20 kg. The "heavy" weight indication corresponds to Products over 20 kg.
Article 7 - Conformity of your order
When you receive your order, you must imperatively proceed to the opening of this last one and to its verification, as well as concerning the conformity and the quantity of the products.
In case of difficulties related to the content of the package, you can issue the necessary reservations, detailed, legible, as precise as possible in case of anomalies found (breakage, non-conformity, product error, color and / or different dimensions, missing etc...)

Make sure to specify the relevant order number within 3 days, not including holidays, of delivery.
We would also be grateful if you could send us a photograph of the product which you consider to be non-compliant.
In the event of proven non-compliance or if Lignea Kids agrees commercially to take back your product, the new shipment of the products in question will be made within the limits of stock availability. Failing this, Lignea Kids will cancel the unavailable product and reimburse it.
Article 8 - Right of withdrawal
In accordance with the regulations in force, for any purchase of products effected on the Site, You have a withdrawal period of fourteen (14) days, from the receipt of the goods, allowing you to cancel your orders in whole or in part.
In order to facilitate the management of product returns and to ensure that the Products are transported in the best possible conditions, the Products must be returned in their original packaging, accompanied by all accessories and instructions, be in good condition, and accompanied by the invoice. Custom-made products cannot be subject to the right of withdrawal.

In accordance with the legal provisions, we undertake to reimburse you for all sums paid with the exception of shipping costs and this within a maximum period of fourteen (14) days from the recovery of the products and or receipt of the proof of shipment of the products.
We will proceed with the refund using the same payment method used for the payment of the order.
Article 9 - Warranties - Service
9.1. Conformity warranty :
Lignea Kids is responsible for the Product's lack of conformity to the Contract, under the conditions of articles L.211-4 and following of the French Consumer Code. Subject to the presentation of proof of purchase, the Customer has a period of two (2) years from the delivery of the Product to assert the legal warranty of conformity.
In case of lack of conformity, You choose between repairing or replacing the Product However, We may not proceed according to your choice if this would entail a cost that is clearly disproportionate to the other proposed modality, taking into account the value of the good or the importance of the defect If, however, none of the envisaged solutions can be implemented within one month of the complaint, You have the possibility of requesting a reduction in the price or the resolution of the contract. 9.2. Warranty of latent defects:
We shall be held liable for any latent defects in the Product under the conditions set forth in Articles 1641 et seq. of the Civil Code. Subject to the presentation of a proof of purchase, the Customer may invoke the guarantee of hidden defects within a period of two (2) years from the discovery of the defect. In order to benefit from the warranty for latent defects, You must prove that the defect was not apparent, existed at the time of purchase and renders the Product unfit for the use for which it was intended, or significantly diminishes such use. If You bring such proof, You may choose between the resolution of the sale or a reduction of the sale price, in accordance with Article 1644 of the Civil Code.
The legal guarantee of conformity and the guarantee against hidden defects apply independently of any commercial guarantee that may be granted.

Article 10 - Liability
Lignea Kids cannot be held liable if the Customer does not comply in whole or in part with the Terms and Conditions of Sale or in case of unforeseeable act of a third party or in case of force majeure.
Lignea Kids may in this case be exempted from all or part of its liability by providing proof of the non-performance or improper performance of these Terms and Conditions of Sale, either when the latter are attributable to the Customer, or when it is the unforeseeable and insurmountable fact of a third party to the contract or then consecutive to a case of force majeure recognized as such by case law.
Article 11 - Retention of title
The goods delivered shall remain the property of Lignea Kids until full payment of their price. Failure to pay may result in the goods being reclaimed. The transfer of the risks of loss or deterioration shall take place in the hands of the Customer as from the delivery of the products.
Article 12 - Personal Data
Lignea Kids attaches great importance to the protection of and respect for the privacy of its Customers and their personal data. Lignea Kids' personal data protection policy aims to inform Customers of practices regarding consent, collection, use, storage, security measures, retention period(s), recipient(s) and sharing of personal data that the Customer, is asked to provide during a purchase by creating an account.

Thus, Lignea Kids protects the privacy of its Clients by complying with the legislation in force and by following its internal rules relating to the protection of Lignea Kids' personal data which it has adopted to preserve and guarantee, the rights of Clients over the data they entrust to it.

Article 13 - Intellectual Property
All visuals, videos, and photographs visible on the Site, and in particular those representing and illustrating the Products are necessarily protected by copyright and all other intellectual property rights and belong to the Seller or to third parties who have authorized the Seller to exploit them.
Any reproduction and/or representation of any kind whatsoever, without authorization, of a visual, an image, a video or a photograph represented on the Site is constitutive of an infringement and will be prosecuted.
Similarly all other data of any kind, and in particular text, graphics, logos, icons, images, photographs, audio or video clips, trademarks, software, features of the site appearing on the Site are necessarily protected by copyright, trademark law and all other intellectual property rights, and belong to the Seller or to third parties who have authorized the Seller to exploit them.
Seller grants Customer a private, non-collective and non-exclusive right to use said data.
The Customer agrees under these conditions not to reproduce, summarize, modify, alter or rediffuser, without the prior express permission of the Seller, any text, title, application, software, logo, image, photograph, graphic chart, video, brand, information or illustration, for any purpose other than strictly private
Article 14 - Dispute Management

Article 15 - Applicable Law and Competent Court
These Terms and Conditions of Sale are governed by French law. In case of dispute, an amicable solution will be sought beforehand. Any dispute relating to the execution of the present Conditions will be under the exclusive jurisdiction of the French courts.
